European ruling saves the day for vacationers

Workers will be able to claim back holidays should they fall ill or suffer injury while away

A European Court of Justice ruling has paved the way for Spanish holidaymakers to claim back days of their annual getaway in the instance that they fall ill or are injured while on vacation.

Spanish law until now had allowed for days to be recouped by workers unable to attend due to giving birth or pregnancy. It also permits people who become ill or suffer an accident to postpone their vacation without losing any of their annual allowance but did not take into account such unforeseen circumstances while somebody is already on holiday.

Labor unions has pushed for this right to be set in Spanish law but met resistance from Anged, the lobbying group that represents warehouse owners. The High Court sided with the unions and Anged appealed to the Supreme Court, which referred the matter to Luxembourg.
