Actress Elsa Pataky wins suit over sneaked topless pics
Spanish star was posing for a glamour shoot when undercover photographer took more revealing shots
Elsa Pataky has won her case against the magazine Interviú and its publishers for printing nude photographs of the Spanish actress taken without her authorization in Mexico, where she was posing for another publication.
The Supreme Court ruled that Ediciones Zeta S.A., Zoom Ediciones S.L., Ediciones Primera Plana S.A. and Zeta Digital S.L. must pay Pataky a total of 620,000 euros between them for invading her privacy.
Pataky was posing topless but with her hands covering her breasts in March 2007 for photographs that were to appear in Elle magazine.
But another photographer took a nude shot of her from the side, and another of her changing clothes. The topless picture of Pataky then appeared on the cover of Interviú.
A Madrid court first ruled that the photos were not an invasion of her privacy because they were taken on a beach and she is a public figure. But the Supreme Court revoked that ruling, saying that Pataky had chosen the Mexican resort location for a private photo shoot.
